The petitioner has filed this writ petition seeking following reliefs: “10.1. 10.1 Hon'ble Court may be kind and gracious enough to call for the records of the case from the respondents. 10.2 Hon'ble Court may be kind be pleased quash and set aside the promotion order dated 29.01.2026(P/1) to the extent whereby private respondent has been illegally promoted. 10.3 The Hon'ble Court may kindly be pleased to pass ari appropriate direction to the respondent authority for considering the petitioner for promotion by issuance of writ of mandamus or 2 any other writ/writs, order/orders or direction/directions according to the gradation list published on 01.04.2025 (P/7) and the name of the petitioner to be considered. 10.4 The Hon'ble Court may kindly be pleased to pass an appropriate direction to the respondent authority for setting aside the order dated 01.07.2025by issuance of appropriate writ/writs, order/orders, direction/directions 10.5 Hon'ble Court may be kind be pleased to direct the respondents to correct the seniority position and to provide promotional benefits to the petitioner. 10.6 Any other relief/relief's which Hon'ble court may deem fit in the facts and circumstances of the instant case.” 2. Counsel for the petitioner submits that the petitioner and respondent No. 2 were initially appointed on 1997-99 and thereafter they were promoted on the post of Nij Sachiv (Private Secretary). With the permission of the State Government, 19 supernumerary post of staff officers was created in order to grant promotion to the Nij Sachiv (Private Secretary) in the Secretarial Service. It is contention of counsel for the petitioner that the supernumerary post are for limited period till the employee who is promoted on the post retires and thereafter, according to the circular issued in this regard, the said supernumerary post will be converted to the post of Nij Sachiv i.e. Private Secretary. 3. It is also the contention of counsel for the petitioner that while passing the order of promotion dated 29.01.2026 (Annexure-P/1), the respondent authorities have considered the gradation list which was defective as the petitioner was not placed in the gradation list at appropriate place. It is also contention of counsel for the petitioner that the petitioner had submitted representation before respondent No. 1 raising all the grievance as raised in the writ petition on 13.01.2026, 3 however, it is not considered and decided, therefore, this writ petition is filed. 4. Counsel for the State submits that as the submission of counsel for the petitioner is that the petitioner had submitted representation, which is pending consideration, it will be considered, in accordance with law, if it is still pending consideration. 5. I have heard learned counsel for the parties. 6. Considering the nature of grievance raised and further submission of counsel for the petitioner that the representation submitted by the petitioner is still pending consideration before respondent No. 1, I find it appropriate to dispose of this writ petition at this stage, directing respondent No. 1 to consider and take decision on the representation dated 13.01.2026 (Annexure-P/10), in accordance with law, expeditiously, preferably within further period of four months from the date of receipt of the Order, on its own merits. 7.
