The present application has been filed under Section 483 of the Bharatiya Nagarik Suraksha Sanhita, 2023 (hereinafter referred to as the ‘BNSS’) seeking grant of regular bail in FIR No. 832/2021, registered at Police Station Paschim Vihar West, for the offences punishable under Sections 307/34 of the Indian Penal Code, 1860 (hereinafter referred to as the ‘IPC’) and Sections 25/27/29 of the Arms Act. 3. Learned counsel for the petitioner submits that the petitioner has remained in judicial custody for the last about four years. He submits that the investigation stands concluded and the charge-sheet has already been filed. It is further submitted that the material witnesses, including the complainant/victim, have already been examined before the learned Trial Court and therefore, there is no likelihood of the petitioner influencing them. 4. However, he opposes the application on the ground that the allegations against the petitioner are serious in nature. 5. Heard learned counsel for the parties and perused the material placed on record. 6. Considering that the petitioner has remained in judicial custody for a substantial period of about four years, the investigation has been completed, the charge-sheet has already been filed, and the complainant has already been examined before the learned Trial Court, this Court is of the view that the continued incarceration of the petitioner is not warranted. 7. In view thereof, the present application is allowed. The applicant is directed to be released on regular bail, on him furnishing a personal bond in the sum of Rs. 25,000/- with one surety of the like amount, to the satisfaction of the learned Trial Court/Link Court, further subject to following conditions: i. The applicant shall not leave India without prior permission of the learned Trial Court. ii. The applicant shall intimate the learned Trial Court by way of an affidavit and to the Investigating Officer regarding any change in residential address. iii. The applicant shall appear before the learned Trial Court as and when the matter is taken up for hearing. iv. The applicant is directed to give his mobile number to the Investigating Officer and keep it operational at all times. v. The applicant shall not, directly or indirectly, tamper with evidence or try to influence the witness in any manner. This is a digitally signed order.
