Heard the parties. Though notice has validly been served upon the Opp. Party no. 2 but no one turns up on behalf of the Opp. Party no. 2.
This criminal miscellaneous petition has been filed at the instance of the petitioners for restoration of ABA No. 3336 of 2024 to its original file.
Learned counsel for the petitioner submits that the ABA No. 3336 of 2024 was dismissed vide order dated 20.02.2025 for non-compliance of the order of filing supplementary affidavit within peremptory period.
Learned counsel for the petitioner submits that as the petitioner could provide information regarding his criminal antecedent, hence, the said
order could not be complied in time, which resulted in dismissal of ABA No. 3336 of 2024. It is further submitted that the petitioner has very good grounds to agitate in this case and unless the same is restored to its original file, the petitioner will be highly prejudiced. Hence, it is submitted that ABA No. 3336 of 2024 be restored to its original file.
Learned Addl. P.P. has no serious objection for the prayer of restoration.
Considering the aforesaid submission of the learned counsel for the petitioner, ABA No. 3336 of 2024 is restored to its original file to the stage, at which, it was before its dismissal.
List ABA No. 3336 of 2024 after a week before an appropriate Bench. This criminal miscellaneous petition is disposed of accordingly.
