This second petition has been filed for grant of regular bail to the petitioner(s) in case bearing FIR No.15 dated 16.01.2024, registered under Section(s) 459, 323, 506, 148, 149 (Sections 302/325 added later on) of the Indian Penal Code, 1860 at Police Station Sadar Mansa, District Mansa, after having the earlier bail petition dismissed as withdrawn vide order dated 29.09.2025. 2. Brief facts of the present case as per the version of the prosecution is that on 13.01.2024, during the festival of Lohri, the MANGAL SINGH 2026.04.17 18:52 I attest to the accuracy and integrity of this document 2 203 CRM-M-16897-2026 (O&M) complainant Jagtar Singh and his brother Jagmail Singh were present near a bonfire at the common place in village Saharna, whereupon an altercation arose between Jagmail Singh and Jagroop Singh s/o Shri Gurdev Singh, who was in an inebriated state. Subsequently, at approximately 8:30 PM, whilst the complainant and Jagmail Singh were engaged in conversation in a room adjacent to the gate of Jagmail Singh's residence, a group allegedly comprising Pargat Singh s/o Jagroop Singh armed with a firearm, Baljeet Singh s/o Shri Jagroop Singh armed with a kirpan, Jagroop Singh s/o Shri Gurdev Singh armed with an iron rod, the Jagga Singh (petitioner) armed with a kirpan, Balkar Singh armed with a kirpan (both sons of Shri Sukhdev Singh), Jeet Singh s/o Shri Seera Singh armed with a hand-pump handle, along with 8-9 unidentified persons, unlawfully trespassed into the said residence whilst raising lalkaras and commenced an assault upon Jagmail Singh. It is stated that Baljeet Singh inflicted a blow with the kirpan on the forehead of Jagmail Singh, Jagroop Singh administered two blows with the iron rod on his left leg, and Jeet Singh struck his right leg with the hand- pump handle, thereby causing him to collapse at the doorway. Thereafter, it is further alleged that Balkar Singh, with intent to cause death, aimed a kirpan blow at the neck of Jagmail Singh which landed on his left jaw, and the petitioner Jagga Singh, with similar intent, inflicted a kirpan blow on his head. Upon the complainant and the wife of Jagmail Singh raising an alarm by exclaiming "na maro na maro", Pargat Singh brandished the firearm towards them, following which the assailants decamped from the scene, with some mounting guard at the gate and others ascending the rooftop of MANGAL SINGH 2026.04.17 18:52 I attest to the accuracy and integrity of this document 3 203 CRM-M-16897-2026 (O&M) Jagroop Singh's house, issuing threats to obstruct medical evacuation and to harm any intervening villager. The complainant thereupon called his relative Jassa Singh r/o Lakhmirwala, who was impeded from approaching, and dialled 100, resulting in the arrival of the police patrolling vehicle from Kotdharmu, whereafter the miscreants fled. 3. Learned counsel appearing on behalf of the petitioner contends that the petitioner has been in custody since 10.02.2024 and has undergone an actual custody of 02 years 02 months and 06 days. It is contended that the case of the petitioner is at par with co-accused/Baljeet Singh @ Jeeti, who has already been granted the concession of regular bail vide order dated 05.03.2026 passed by this Court in CRM-M-68985-2025 titled as ‘Baljeet Singh @ Jeeti Vs. State of Punjab’. He prays for grant of concession of regular bail to the petitioner on parity with the aforesaid co-accused. 4. Learned counsel for respondent-State as well as counsel for the complainant do not dispute the aforesaid factual aspects. 5. Taking into consideration the nature of allegations levelled against the petitioner, the circumstances resulting in the death of deceased- Jagmail Singh, the period of custody already undergone by the petitioner, his clean antecedents as well as the stage of trial and noticing that there would be arguable issues that may arise for adjudication before Trial Court in relation to making out of the offence under Section 302 of the Indian Penal Code, 1860 and bearing in mind that co-accused of the petitioner have already been granted the concession of bail, I deem it appropriate to allow the present petition. Accordingly, the instant petition is allowed and the petitioner is ordered to be admitted to regular bail subject to his furnishing bail/surety bonds to the satisfaction of the trial Court/Duty Magistrate/Illaqa Magistrate concerned. 7. It is made clear that the petitioner shall not extend any threat and shall not influence any prosecution witness in any manner directly or indirectly. 8. The observation made hereinabove shall not be construed as an expression on the merits of the case and the trial Court shall decide the case on the basis of available material. (VINOD S.
