The present application under Section 528 of the Bharatiya Nagarik Suraksha Sanhita has been filed to quash the entire proceedings of Session Trial No. 252 of 2024, arising out of Case Crime No. 15 of 2024, under Section 376 IPC, Police Station- Bidhuna, District- Auraiya as well as cognizance/ summoning order dated 6.3.2024, pending in the Court of Sessions Judge, Auraiya. Learned counsel for the applicant fairly admits that charge has been framed in the present case on 5.11.2024, which has not been challenged till today. It is further submitted that the impugned FIR has been lodged within three days of the incident. After some arguments, learned counsel for the applicant does not want to press the present application. In view of above, the present application is dismissed as not pressed.
