1. The present writ petition has been filed seeking a direction to the respondent-MCD to take action against the unauthorized construction being carried out at property bearing no. 3/3438, Raigar Pura, Karol Bagh, New Delhi - 110005 area measuring 100 sq. yds. approx. (including extending balcony (‘subject property’). 2. The petitioner has made a written complaint to the respondent-MCD on 7th May, 2026. 3. It is stated that the said construction is being carried out without any sanctioned plan. It is further stated in paragraph 2 of the writ petition that the petitioner resides in the vicinity. 4. Mr. Kapil Dutta, counsel appearing on behalf of respondent-MCD on advance notice submits that the petitioner resides in Gali No.4 whereas the This is a digitally signed order. W.P.(C) 10523/2026 subject construction is being carried out in Gali No.9. Therefore, the ongoing construction does not prejudice the petitioner in any manner. 5. Counsel for the petitioner submits that the petitioner resides on the backside of the subject property. However, there is no averment in the petition in this regard. 6. Even if the petitioner is residing on the back side of the subject property, there is nothing to show that the petitioner is directly affected by the ongoing construction. The petitioner has failed to show as to how any fundamental or legal right of the petitioner is being affected by the alleged construction activity carried out in the subject property. 7. Mr. Kapil Dutta submits that the construction is being carried out pursuant to a sanctioned plan. 8. A copy of the sanction plan is handed over in Court and the same is taken on record. 9. In view thereof, this Court is not inclined to entertain the present writ petition and accordingly the petition is dismissed.
