The petitioner prays for the following reliefs:- (i) For commanding upon the respondents to show cause as to why the amount of compensation as has been determined/enhanced by the Court of the Additional Collector- cum- Arbitrator Seraikela-Kharsawan, passed in Land Acquisition Arbitration Case No. 30/2020, Bipad Taran Pandey & Ors. versus the Deputy Commissioner, Seraikela-Kharsawan 2026:JHHC:12422 2 and others, dated 08.08.2022 (Annexure 2) has not been paid to the petitioner. (ii) For commanding upon the respondents NHAI to act upon the letter dated 29.11.2022 contained in letter no. 618 (Annexure-3) by which the Competent Authority cum-The District Land Acquisition Officer, Seraikela-Kharsawan has requested the Project Director, National Highway Authority of India, PIU, Purulia to provide funds amounting to Rs. 45,42,627.00 (Rupees Forty-five Lakhs Forty-Two Thousand Six Hundred and Twenty-Seven only) including the awarded amount to the petitioner amounting to Rs.1,93,984.00 (Rupees One lakh Ninety-three thousand nine hundred and eighty four only) in order to make payment of enhanced compensation amount in terms of award determined by the Additional Collector-cum- Arbitrator, Seraikela-Kharsawan (iii) For making payment of the awarded amount to the petitioner with interest (statutory as well as penal) particularly in terms of section 3H of the National Highways Act, 1956, which has not been paid to the petitioner till date and that too without assigning any reason. 3. It is the case of the petitioner that the petitioner claims balance of compensation amount, which, the petitioner is entitled to after enhancement of the compensation amount by the Additional Collector-cum-Arbitrator. The fact that the petitioner has received the initial amount is not in dispute. After receiving of the initial amount, 2026:JHHC:12422 3 the respondents have enhanced the compensation amount. Once the compensation amount is enhanced, the petitioner is also entitled to get the benefit of the same. 4. Thus, I direct the respondents No.4 The District Land Acquisition Officer, Seraikela-Kharsawan to disburse the enhanced amount of compensation to the petitioner along with statutory interest. The entire process should be concluded with a period of 12 weeks from the date of receipt of the copy of this order. 5. With the aforesaid observation, this writ petition is disposed of.
