1. This application is filed jointly on behalf of the Petitioner and Respondent No.1 under Order XXIII Rule 3 read with Section 151 CPC for recording of settlement between parties. 2. This petition was filed on behalf of the Petitioner under Sections 47 and 57 of the Trade Marks Act, 1999 read with Rules 125 of Trade Marks Rules, 2017 seeking rectification/cancellation of the trademark JOTIK registered in favour of Respondent No. 1 under registration No. 5390249 in Class 06. 3. During the pendency of the petition, parties have amicably resolved their inter se disputes and terms of settlement are incorporated in paragraph 2 of the application. Respondent No. 1 has acknowledged that Petitioner is the prior adopter and proprietor of trademark JYOTI in respect of goods This is a digitally signed order. falling under Class 06, namely, angles, channels, girders, H-beams, I-beams, flats, rounds and other structural steel products. Respondent No. 1 has undertaken not to oppose, challenge or dispute the validity, subsistence or enforceability of Petitioner’s rights in the trademark JYOTI and to surrender the registration in the impugned mark JOTIK, for which it shall file an appropriate application before the Registrar of Trade Marks. 4. Court has perused the terms of settlement and finds the same to be lawful. Accordingly, this application is allowed and disposed of, recording the settlement between the parties. C.O. 5. This petition is allowed taking on record the settlement between the parties and accordingly, registration of the mark JOTIK in Class 06 under registration No. 5390249 in favour of Respondent No.1 is cancelled. 6.
Respondent No. 2/Registrar of Trade Marks is directed to remove the entry of trademark JOTIK from the Register of Trade Marks within a period of six weeks from today. Copy of the order will be communicated to the Registrar by the counsel for the Petitioner. 7. Petition stands disposed of. 8. Date of 09.09.2026 is cancelled.
