Rakib (rejected) CRM (NDPS) 18 of 2026 In Re: An Application for Bail under Section 439 of the Code of Criminal Procedure, 1973/Under Section 483 of the Bharatiya Nagarik Suraksha Sanhita, 2023 in connection with Islampur Police Station case no. 279 of 2025 dated 23.03.2025 under Sections 21(c)/23(c) of the Narcotic Drugs and Psychotropic Substances Act, 1985. Learned advocate appearing for the petitioners submits that petitioners have been implicated on the basis of recovery of 207 bottles of cough syrup from the possession of petitioner along with other. Petitioners are in custody since March 25, 2025. Learned advocate for the State opposes the prayer for bail as commercial quantity of contraband has been seized. I find that for about ten months the petitioners are in custody, date has been fixed for consideration of charges. Consequently, I direct the learned Judge, Special Court under NDPS Act, Raiganj, Uttar Dinajpur to release the petitioners on bail after the stage of consideration of charges are over on such terms and conditions as he deems fit and proper for ensuring the appearance of the both the accused persons in course of the trial. 2 With the aforesaid observations CRM (NDPS) 18 of 2026 is disposed of. All parties shall act in terms of server copy of the order downloaded from the official website of this Court.
