HON'BLE THE CHIEF JUSTICE HON'BLE MR. JUSTICE TEJAS KARIA O R D E R % 30.07.2026
1. Heard the learned Counsel for the Parties. 2. This intra court Appeal seeks to take exception to the order dated 25.06.2026 passed by the learned Single Judge in W.P.(C) 8114/2026 (“Writ Petition”) instituted by Respondent No. 1, whereby the learned Single Judge directed the Appellant to allow Respondent No. 1 to register him for counselling physically from 26.06.2026 to 28.06.2026. 3. Subsequently, an order has been passed on 10.07.2026 by the learned Single Judge directing the Appellant that in case Respondent No. 1 is found eligible for getting a seat in Computer Science and Engineering branch at Delhi Technical University (“DTU”) as per his rank, he shall be so allotted This is a digitally signed order. LPA 507/2026 p. 2 the same. This order dated 10.07.2026 has also been challenged by the Appellant in these proceedings. 4. The orders under challenge in these proceedings are, thus, interlocutory in nature and as a matter of fact, these orders have duly lived their lives for the reason that pursuant to the order dated 25.06.2026, Respondent No. 1 was permitted to be registered for counselling and further, so far as the order dated 10.07.2026 is concerned, the 3rd Round Counselling, as submitted on behalf of the Appellant, had taken placed on 07.07.2026 and in the 4th Round Counselling held on 14.07.2026, no seat in Computer Science and Engineering at DTU was available, as has been asserted on behalf of the Appellant, though the said statement is being disputed by learned Counsel for Respondent No. 1. 5.
5. We have also been informed that some contempt petition has also been instituted by Respondent No. 1 for alleged non-compliance of the order dated 10.07.2026 passed by the learned Single Judge. 6. The issue, which engages attention of the learned Single Judge in the Writ Petition is as to whether Respondent No. 1, as Overseas Citizen of India (I), is eligible to participate in the Joint Admission Counselling and, therefore, unless Respondent No. 1 is declared to be eligible for his participation in the Joint Admission Counselling, no further direction, as has been prayed for by Respondent No. 1 in the Writ Petition, can be issued. 7. Thus, in our opinion, the said issue needs to be decided at the earliest to put the controversy at rest. 8. In view of the aforesaid, we direct that on behalf of the Appellant, in addition to any affidavit filed earlier in the Writ Petition, an additional affidavit shall be filed, bringing on record of the Writ Petition, the requisite This is a digitally signed order. LPA 507/2026 p. 3 information, facts and documents. While filing the additional Affidavit, the Appellant shall also indicate the ranks of the candidates, last selected in each round of counselling in the Computer Science and Engineering branch at DTU. This additional Affidavit shall be filed by the Appellant in the proceedings of the Writ Petition by Saturday, that is, 01.08.2026 after serving a copy thereof upon learned Counsel for Respondent No. 1, who may file his Rejoinder thereto, if any, by the next date of listing of the Writ Petition. 9. We have been informed that both the Writ Petition as also the contempt petition are listed on 03.08.2026. Accordingly, we request the learned Single Judge to expedite the proceedings of the Writ Petition and decide the same at the earliest, whereafter the contempt petition shall be taken up for decision in accordance with the respective cases of the Parties. 10. We further provide that no adjournment in the proceedings of the Writ Petition shall be admissible to either Party, except in very exceptional circumstances, that too only with the leave of the learned Single Judge. 11.
With the aforesaid observations, the Appeal stands finally disposed of. Pending Application(s), if any, also stand disposed of.
