By way of filing this writ petition under Article 226 of the Constitution of India, the petitioner seeks issuance of direction to respondent No.4-Tahsildar Akaltara, Distt. Janjgir Champa (CG) to decide application dated 03.03.2025 (Annexure-P/1) filed by the petitioner, within stipulated period. Learned counsel for the petitioner submits that respondent No.5 is step mother of the petitioner and after the death of petitioner’s father, property was partitioned between the family members. However, respondent No.5 has encroached upon some portion of the share of the petitioner, hence, the petitioner filed application dated 03.03.2025 (Annexure-P/1) under Section 250 of the Chhattisgarh Land Revenue Code, 1959 (for short ‘the Code 1959’) before respondent No.4-Tahsildar, Akaltara, Distt. Janjgir-Champa (CG). However, the same has not been decided yet. Hence, it is prayed that this petition may be disposed of directing respondent No.4 to decide his application at the earliest. 3. In reply, learned counsel for the State, submits that the application filed by the petitioner is under consideration and the same shall be decided expeditiously. 4. Heard learned counsel for the parties and perused the material available on record. 5. Having considered the contention of learned counsel for both the parties and the limited prayer of the petitioner, without entering into the merits of the case, this petitioner is disposed of directing respondent No.4-Tahsildar, Akaltara, Distt. Janjgir-Champa (CG) to decide the application dated 03.03.2025 filed by the petitioner under Section 250 of the Code, in accordance with law, as early as possible, preferably within a period of 45 days from the date of receipt of a copy of this order. 6.
