Mr. Ankush Singhal, Advocate for the petitioners. Mr. Sandeep Sharma, learned A.G.A. for the State. 2. It is submitted that both the petitioners belong to the same faith and both are major. Petitioner no. 1 Sonam Bi is 19 years and 09 months of age and petitioner no. 2 Rizwan Khan is 23 years of age. Though, they belong to State of Uttar Pradesh, but, they intend to permanently settle at Uttarakhand and petitioner no. 2 is residing in the State of Uttarakhand since last two years and they are in love and they want to marry each other, but, the family members of petitioner no. 1 are against their marriage. 3. Since the family members of the petitioner no. 1 are against this marriage, they are giving out threats to kill both the petitioners. Petitioners submit that they are facing stiff resistance, and they seriously apprehend threat to their life and limb from the family members of petitioner no. 1, and hence they are before this Court praying for protection. 4. The documents on record reveal that both the petitioners are majors, and it is also submitted by the counsel for the petitioners that they are planning to marry in a fortnight and thereafter they want to get their marriage registered under the UCC and have sought protection till then. 5. Individuals, who are major and competent to marry, are free to marry anyone they like. If family members of any individual are not agreeable to such marriage, the law does not empower them to extend threats or harass such individuals. 6. In that view of the matter, and in view of the ruling of the Hon'ble Supreme Court in the case of Lata Singh Vs State of U.P. and another, reported in (2006) 5 SCC 475, the petitioners have made out a case for grant of protection. 7. The Station House Officer, Police Station Pulbhatta, District Udham Singh Nagar is directed to assess the threat, if any, to the life and limb of the petitioners, and provide necessary protection, if it is found that there is a threat to the life and limb of the petitioners. The SHO is further directed to summon the private respondent, and such other persons, who are inimically placed towards the marriage of the petitioners, and counsel them, in accordance with law. 8. Since both the petitioners are major and have decided to marry each other on their own sweet will, therefore, the writ petition stands disposed of. Parties are advised to maintain peace.
