KUMAR SWAMY NAIDU AGED ABOUT 35, OCC AGRICULTURE, R/O.GOLLAPALLI VILLAGE, V.KOTA MANDAL CHITTOOR DISTRICT.517424 ...RESPONDENT(S): Counsel for the Petitioner: B.V.DURGA PRASAD Counsel for the Respondent(S): GP FOR HOME The Court made the following: ORDER: The Writ Petition has been filed under Article 226 of the Constitution of India seeking the following relief:- “…to issue a writ order or direction more particularly one in nature of Writ of Mandamus declaring the inaction on the part of the respondents No 2 to 5 in registering the crime on the complaint dated 25.03.2026 submitted by petitioner against the respondents No 7 and 8 arbitrary illegal abdication of the statutory duty cast on them and voilative of the fundamental rights guaranteed to petitioner under Articles 14 19 and 21 of the Constitution of India and consequently direct the respondent No 2 to 5 to register a crime against the respondents No 7 and 8 basing on the complaint dated 25.03.2026 submitted by petitioner and pass….” 2. Heard the learned counsel for the petitioner and the learned Assistant Government Pleader. 3. Sri B.V. Durga Prasad, learned counsel for the petitioner, submits that the complaint of the petitioner dated 25.03.2026 has not been registered as an FIR and no investigation has been conducted. 4. Sri P. Ajay Babu, learned Assistant Government Pleader, on written instructions, submits that the complaint of the petitioner was not received by 3 Dr. YLR, J W.P.No.11636 of 2026 Dated 01.05.2026 the concerned police, and certain documents are filed to show that no such complaint was received by the respondent police. 5. Be that as it may, the petitioner is directed to resubmit the complaint afresh within a period of one week from the date of receipt of the copy of this order. Upon such submission, Respondent No.6 is directed to take appropriate action in accordance with law and submit a report to the Superintendent of Police concerned. 6. Having regard to the entire facts and circumstances of the case, and recording the submissions of the learned Assistant Government Pleader, the Writ Petition is disposed of.
