The petitioner is apprehending his arrest in connection with Birni (Bharkatta OP) P.S. Case No. 160 of 2024. It has been alleged that the daughter of the informant died in unnatural circumstances at her matrimonial house. Submissions has been advanced by the learned counsel for the petitioner that the petitioner is not named in the First Informant Report and the entire allegations have been levelled against the husband and the in-laws of the deceased. It has been submitted that subsequently the petitioner has been implicated in course of investigation on the account of the speculative statement of the witnesses that the deceased was having a love affair with the petitioner and the petitioner was forcing the deceased to marry him by blackmailing her with some photographs. Learned counsel submits that the petitioner does not have any criminal antecedent. Learned A.P.P. for the State opposed the prayer for anticipatory bail of the petitioner and submitted that as per the C.D.R. the petitioner was in taking terms with the deceased. Regard being had to the fact that suspicion has been cast upon the petitioner of having relationship with the deceased and absence of any material that suggest that the petitioner had abetted the deceased to (2026:JHHC:15626) commit suicide, I am inclined to extend the privilege of anticipatory bail to the petitioner. Accordingly, the petitioner above named is directed to surrender in the court below within four weeks and pray for bail, and in that event, he shall be released on bail on furnishing bail bond of Rs. 10,000/- (Ten Thousand) with two sureties of the like amount each, to the satisfaction of learned CJM, Giridih in connection with Birni (Bharkatta OP) P.S. Case No. 160 of 2024, subject to the conditions as laid down under Section 482 (2) of the Bhartiya Nagrik Suraksha Sanhita, 2023. This application stands allowed.
