Heard Ms. S.B. Choudhury, learned Counsel for the petitioner and Ms. S.H. Bora, learned Additional Public Prosecutor for the State. 2. By this application, the petitioner has prayed for bail in connection with Hailakandi P.S. Case No. 130/2026 registered under Sections
Page No.# 2/3 316(2)/319(2)/318(4)/112(2)/351(2) of the BNS, 2023. The FIR in connection with which the petitioner was arrested on 03.08.2026 was lodged by the victim namely Muzakir Hussain Barbhuiya stating inter alia that the petitioner had assured him that he can procure one government job for him and that he asked for some money and that the informant had given a total amount of Rs. 4,28,998/- to the petitioner and others. However, the informant stated that more than two years have elapsed but the petitioner along with others had neither given the appointment letter nor have returned the money. 3. Ms. S.B. Choudhury, learned Counsel for the petitioner submits that other accused persons in whose account some money was deposited were already enlarged on bail and that the petitioner has been inside the jail for 36 days. 4. Ms. S.H. Bora, learned Additional Public Prosecutor for the State, however, submits that the main accused person is the petitioner as he is the one who had promised that he will get a job for the informant and as such has prayed for calling of the Case Diary. 5. Upon consideration of the submissions made by the learned Counsel for the parties, more so, in view of the fact that the petitioner has been incarcerated for long and that his statement was also recorded, this Court deems it fit to enlarge the petitioner on bail on furnishing of bail bond of Rs. 20,000/- with one local surety of the like amount to the satisfaction of CJM, Hailakandi under the following conditions:
i) the petitioner will appear before the Investigating Officer as and when call for.
ii) the petitioner will not hamper, tamper with the evidence, neither
Page No.# 3/3 influence the witnesses connected with the case. iii) the petitioner will not leave the place of jurisdiction without the permission of the concerned Court. 6. Petition is disposed of. JUDGE Comparing Assistant
