Learned counsel for the petitioner submits that the petitioner has already filed an appropriate application before learned trial Magistrate for passing appropriate orders on the application of the petitioner in order to ensure the fair, proper and independent investigation. Therefore, the petitioner may be allowed to withdraw this petition with liberty to pursue the application filed by her before the learned trial Magistrate. [2026:RJ-JP:31600] (2 of 2) [CRLMP-3487/2026] 2. In light of the submission made by the counsel for the petitioner and taking into consideration the law laid down in the case of Sakiri Vasu Vs. State of U.P., reported in AIR 2008 SC 907, this criminal misc. petition is dismissed as withdrawn. However, petitioner would be at liberty to pursue the application which is pending before the learned trial Magistrate. Learned trial Magistrate is also requested to take appropriate steps in order to ensure the fair, proper and independent investigation in accordance with law. 3.
