No.144 of 2025 arising out of Amrapara P.S. Case No. 23 of 2021 for the offences registered under Sections 147, 148, 149, 120B, 323, 307, 354B, 379, 380, 436, 456, 500, 506, 452 and 509 of the Indian Penal Code pending in the Court of learned Principal Sessions Judge, Pakur, is pressed into motion. 2026:JHHC:3698 It is submitted by the learned counsel on behalf of petitioners that offence under Section 307 of the IPC will not be made out as there is no medical evidence to substantiate the allegation of assault. The case has been lodged by leveling omnibus allegation against 59 persons. The mob was enraged by the murder of a co-villager, but did not made any attempt on the life of the informant party. The FIR has been lodged after 37 days. Other similarly situated co-accused persons have already been granted bail by the co-ordinate Bench of this Court. Learned A.P.P. opposed the bail petitions. It is submitted that by forming an unlawful assembly, female members were also disrobed and paraded nude in public. The genesis of offence is a rumor of murder of Maheshwar Tudu, who had left the village and did not return back. Ladies were paraded nude in the village, there is no other serious allegation. Offence under Section 307 of the IPC does not appear to be made out. Under the circumstances, the above named petitioners are directed to be released on bail on furnishing bail bond of Rs.25,000/-(Twenty Five Thousand) each with two sureties of the like amount each to the satisfaction of the Court below.
