Heard Mr. Ashok Khare, learned Senior Counsel assisted by Mr. Siddharth Khare, learned counsel for the petitioner and Dr. Santosh Kumar Shukla, learned Additional Chief Standing Counsel for the State-respondents. The writ petition has been filed with the following prayers:- "(i) Issue a writ, order or direction of suitable nature commanding the respondents to refix the salary of the petitioner as Asstt. Professor in Bachelor of Education at Baikunthi Devi Kanya Mahavidyalaya, Agra as on 23.7.2022 after according pay protection on account of services rendered by the petitioner from 01.09.2010 till 22.7.2022 at Shri Gandhi Samarak Krishak Inter College, Bera, Mathura, within the period to be specified by this Hon'ble Court and to make regular payment of monthly salary regularly every month in accordance with such refixed salary. (ii) Issue a writ, order or direction of suitable nature commanding respondents to sanction to the petitioner the Conveyance/Vehicle Allowance as is admissible to other Physically Handicapped Employees of Government Departments under Govt. Order dated 22.08.2019 and to disburse the same regularly every month. (iii) Issue a writ, order or direction of suitable nature commanding the respondents to disburse to the petitioner arrears of salary as refixed in Prayer (i) as also the arrears of Conveyance/Vehicle Allowance from 23.07.2022 till date along with interest at the rate of 9% per annum within the period to be specified by this Hon'ble Court.” Learned counsel for the petitioner submits that regarding grievance Versus Counsel for Petitioner(s) : Siddharth Khare, Sr. Advocate Counsel for Respondent(s) : C.S.C. Neetu Gautam .....Petitioner(s) State Of U.P. And 4 Others .....Respondent(s) for pay protection as per the recommendation of the competent authority dated 28.12.2021 as well as for payment of conveyance allowance for physically handicapped as per the Government order dated 22.08.2019 is pending consideration before respondent no.1 Principal Secretary, Department of Higher Education, Govt. of U.P., Lucknow. Therefore, a direction may be issued to the respondent- authorities to decide the same, within stipulated period. Dr. Santosh Kumar Shukla, learned Additional Chief Standing Counsel submits that if the petitioner moves a fresh representation before respondent no.1, the same shall be considered and decided in accordance with law. Considering the facts and circumstances of the case but without expressing any opinion on the merits of the case set up on behalf of the petitioner, the present writ petition is disposed of by providing that the petitioner may make fresh application/representation, ventilating all her grievances, supported by such documents, as may be advised, before the respondent no.1, Principal Secretary, Department of Higher Education, Govt. of U.P., Lucknow, within three weeks from today along with a certified copy of this order. On such representation being made, respondent no.1 shall make all endeavours to consider and decide the same, strictly in accordance with law, by means of a reasoned and speaking order, after giving proper opportunity of hearing to the petitioner, as expeditiously as possible, preferably within a period of two months from the date of production of certified copy of this order, if there is no legal impediment.
