Issue appropriate writ or order or direction to set aside the order dated: 26.11.2025 in O.S.No.8231/2025 passed by the Learned XLII Addl. City Civil and Sessions Judge, Bangalore, a copy of which is herein produced as ANNEXURE-A as illegal and void. ii. Issue appropriate writ or order or direction in the nature of mandamus directing Learned Civil Judge and JMFC, K.R.Puram, Bengaluru Rural to reject IA No.5/2025 and 6/2025 which are produced as Annexure-C and D. iii. Issue such writ or order or direction or other relief(s) that this Hon’ble Court deems fit under the fact and circumstances of the case to secure the ends of justice.” 2. Heard learned Senior Counsel for the petitioner and perused the material on record. 3. Learned Senior Counsel for the petitioner submits that the petitioner, who is defendant No.1 in the suit would file written statement, objections, documents on 21.02.2026 on which date the suit is posted before the trial Court, which may be directed to dispose of the temporary injunction application filed by the plaintiff as expeditiously as possible. - 4 - HC-KAR NC: 2026:KHC:10383 WP No. 5539 of 2026 4. The aforesaid submission is placed on record. 5. In view of the facts and circumstances, I deem it just and appropriate to dispose of the petition by issuing certain directions. In the result, I pass the following: ORDER i) The petition is hereby disposed of. ii) Petitioner - defendant No.1 is directed to file written statement, objections, documents etc. before the Trial Court on 21.02.2026. iii) The Trial Court is directed to dispose of I.A.Nos.5 and 6 within a period of 1 week from 21.02.2026. iv) All rival contentions on all aspects of the matter are kept/left open and no opinion is expressed on merits/demerits of the rival contentions.
