JUSTICE M.NAGAPRASANNA ORAL ORDER The petitioners are before this Court, seeking the following prayer: "a) Quash the order dated 14/11/2025 passed by the senior civil judge and JMFC Holenarasipura allowing the 319 application, in CC.No.1124/2023 thereby taken cognizance against the petitioner/Accused u/s 504,323,324,326, and 506 of IPC consequently the entire proceedings in CC.No.1124/2023 pending on the file of learned senior civil judge and JMFC Holenarasipura as against the petitioner herein/Accused; b) Quash the charge sheet filed by the 1st Respondent/police as against the petitioner/Accused for the offences under Sections 504,323,324,326, and 506 of IPC; and c) Grant such other relief as this Hon'ble Court deems fit in the facts and circumstances of the case, in the interest of justice." 2. Heard Sri. Nandeesha K.R., learned counsel appearing for the petitioners, Sri. Channappa Erappa, learned HCGP appearing for respondent No.1 and have perused the material on record. - 4 - HC-KAR NC: 2026:KHC:16230 CRL.P No. 744 of 2026 3. The petitioners who were embroiled in a crime and drawn in the list of accused while the FIR was registered is dropped while the charge sheet was filed pursuant to investigation. During the trial, it is found that the petitioners were also necessary to be dragged into the web of crime. Therefore, the concerned Court issues summons on an application filed by the prosecution under Section 319 of the Cr.P.C. This is what is called in question in the subject petition. The matter is at the stage of summons. Therefore, there is no warrant of entertainment of the petition at this juncture. 4. Reserving liberty to the petitioners to knock at the doors of this Court in the event the concerned Court would pass any final order on the application, the petition stands disposed.
