MADHAVI DONTHARAJU The Court made the following: ORDER: Heard the learned Counsel for the Petitioner and the learned Assistant Public Prosecutor. 2. The Petitioner and Respondent No.3 are present before this Court and submit that they are first cousins and intend to compromise the matter, as there are elements of settlement. 3. Sri P. Nagendra Babu, learned Counsel, is appointed as Mediator in this case. Pursuant to the directions of this Court, the learned Mediator conducted the mediation proceedings and submitted his report. The said report is hereby accepted. 4. Considering the submissions made by the learned counsel for the parties and in the light of the judgment of the Hon’ble Apex Court in Gian Singh vs. State of Punjab and another1 and K. Bharathi Devi v. State of Telangana2, and having regard to the amicable settlement arrived at between the parties, this Court is of the view that it would be in the interest of justice, the proceedings are quashed in view of the settlement. Consequently, the conviction and sentence imposed by the learned Additional Judicial Magistrate of First Class, Tuni, in C.C.No.91 of 2012, dated 10.04.2018, and confirmed by the learned XII Additional Sessions Judge, Pithapuram, in Crl.A.No.144 of 2018, dated 14.07.2019, are hereby quashed.
