NATARAJ ORAL ORDER The petitioner has challenged an order dated 30.01.2020 passed by the I Additional Civil Judge and JMFC, Kanakapura, in Crl.Misc.No.756/2019. 2. (i) The petitioner filed Crl.Misc.No.756/2019 to register the death of his grandmother in the concerned Register of Births and Deaths and to issue a death certificate. The respondents in the said petition are the respondents in this criminal petition. The trial Court in terms of an order dated 27.12.2019, had issued hand summons to the respondents and also ordered paper publication. On 30.01.2020, the hand summons was served to the respondent Nos.1 and 2, who were called out, but they were absent. Hence, they were placed ex- parte. - 3 - HC-KAR NC: 2026:KHC:15392 WP No. 16384 of 2021 (ii) The petitioner also furnished a paper publication published in Udayakala dated 24.01.2020. The trial Court in terms of the order dated 30.01.2020, directed the petitioner to take one more paper publication in a newspaper having good circulation in the vicinity where the deceased died. Being aggrieved by the said order the petitioner is before the Court. 3. The learned counsel for the petitioner submitted that the respondents are government officials and that the hand summons issued to them is duly served. Nonetheless, they did not appear before the Court and therefore, the trial Court after having placed them ex-parte, could not have directed a fresh paper publication. 4. The learned High Court Government Pleader did not dispute the fact that hand summons is issued to the respondent Nos.1 and 2. 5. In that view of the matter, the following order is passed: ORDER i. This petition is allowed; - 4 - HC-KAR NC: 2026:KHC:15392 WP No. 16384 of 2021 ii. The impugned order passed by the trial Court directing the fresh notice to be published in a newspaper is set aside; iii.
