1. Petitioner seeks quashing of FIR No.350/2016 of PS Mandawali for offence under Section 279/338 IPC on the ground that complainant de facto (respondent no.2) has settled the disputes with the petitioner.
2. Learned APP for the State assisted by IO/SI Chanjang points out that the trial has already substantially conducted in which the eye witness has already been examined before the trial court, so the FIR cannot be quashed.
3. In view of the aforesaid, learned counsel for petitioner seeks permission to withdraw this petition.
4. As requested, the petition and the accompanying application are dismissed as withdrawn. But it is made clear that this withdrawal shall not be read against the petitioner during the trial.
