2. This is an application under Section 483 of BNSS, 2023 for granting regular bail to the petitioners namely (1) Rimpa Hazorika and (2) Tanju Bibi in connection with Orang P.S. Case No. 28/2026 registered Sections 21(b)/ 29 of the NDPS Act, 1985, who were arrested on 03.08.2026. 3. As per the allegation, 90.16 grams of heroin was recovered from the possession of the petitioners while they were travelling in a bus. 4. The learned counsel for the petitioners submits that the petitioners, both of whom are ladies, are having minor children and their detention in custody would cause extreme hardship to their children and family members. 5. The learned Addl. P.P. submits that the petitioner No. 1 Rimpa Hazorika has criminal antecedent and had been earlier arrested in connection with Kharupetia P.S. Case No. 142/2018 and Barpather P.S. Case No. 30/2021 for similar offences. 6. On perusal of the case dairy, there appears sufficient incriminating material against the petitioner No. 1 namely Rimpa Hazorika and having regard to the criminal antecedent of the petitioner No. 1, Rimpa Hazorika, her prayer for bail stands rejected at this stage. 7. With regard to the petitioner No. 2, namely, Tanju Bibi, considering her period of detention of 36 days in custody and the fact that she is a lady who has to care her minor children and her family members and also she is pregnant and she has no criminal antecedent, her prayer for bail is allowed. 8.
Accordingly, the petitioner No. 2 namely Tanju Bibi be released on bail on furnishing a bail bond of 50,000/- with 2 (two) sureties of the like amount to the satisfaction of the learned jurisdictional Magistrate, subject to the conditions that the petitioner No. 2 shall participate in the trial of the case as and when
