Sections 143/127(4)/140(1)/61(2)/318(4) of the BNS, 2023. 3. An FIR was lodged on 19.05.2026, by one Biku Chautal before the Officer- in-Charge, Jakhalabandha Police Station alleging that his two sisters have been taken by one Ram Yadav, a resident of Delhi for providing them job opportunities. It is alleged that the girls have taken two years back, however, neither any information from Ram Yadav nor from the sisters could be received. In view of the aforesaid, the informant apprehends that something wrong have been committed to his sisters. 4. In view of the aforesaid FIR, Jakhalabandha P.S. Case No. 40/2026, was registered under the aforementioned sections. 5. Mr. Biswas, learned counsel for the accused-applicant submits that the sisters of the informant had been taken by the accused-applicant for employing them in Delhi and his firm has engaged both the sisters in certain works and that they have already arrived home on 21.05.2026. Mr. Biswas also submits that there is no foul play in the instant case and since notice under Section 35(3) of the BNSS has been served to the accused-applicant, he has filed the instant application. 6. Taking into account the facts of the case, this Court is of the considered opinion that pre-arrest bail should be granted to the accused-applicant. 7.
Accordingly, it is directed that in the event of arrest of the accused- applicant by the Investigating Officer in connection with Jakhalabandha P.S. Case No. 40/2026, under Sections 143/127(4)/140(1)/61(2)/318(4) of the BNS, 2023, he shall be released on pre-arrest bail on furnishing a bond of Rs. 50,000/-, with surety of like amount to the satisfaction of the arresting
Page No.# 3/3 authority, subject to the following conditions: (i) The accused-applicant shall appear before the Investigating Officer within 10 days from today. (ii) The accused-applicant shall co-operate with the investigation and make himself available as and when required by the Investigating Officer. (iii) The accused-applicant shall not hamper or tamper with the investigation in whatsoever manner. 8. In terms of the aforesaid directions, the instant AB stands disposed of.
