Ms. Shobhana Takiar, counsel appearing on behalf of the petitioners submits that the sanction for the building plan has been rejected by the respondent-MCD for want of NOC from the co-owners of the property bearing no.60/11, Block no.60, Khasra no.896/4, situated at Ramjas Road, Karol Bagh, New Delhi-110005 (‘subject property ’) and therefore, the same is in violation of the judgment passed by this Court in LPA 591/2023 titled MCD v. Sanjeev Malhotra & Anr. 4. Mr. Ashutosh Gupta, counsel appearing on behalf of the respondent- This is a digitally signed order. The same has been rejected on account of other deficiencies in the said application. 5. Taking note of the aforesaid submissions, the present writ petition is disposed of while giving liberty to the petitioners to apply for a fresh sanction of the building plan. 6. Upon filing of a fresh application for sanction of the building plan, the same shall be considered by respondent-MCD in accordance with law. 7. Pending application stands disposed of.
