1. This second bail application has been filed under Section 483 of BNSS, 2023 on behalf of accused-petitioner in connection with FIR No.167/2021 registered at Police Station Mandhan, District Bhiwadi for the offences under Sections 420, 467, 468, 471 and 120-B IPC.
2. Heard.
3. Considered the submissions made by counsel for the petitioner as well as learned Public Prosecutor and also perused the material made available on record.
4. The offences as alleged against the accused-petitioner punishable under Sections 420, 467, 468, 471 and 120-B IPC are triable by the Court of Magistrate. The accused-petitioner is in
[2026:RJ-JP:33863] (2 of 2) [CRLMB-12276/2026] custody since 05.01.2026 and the Police after completion of investigation has already submitted charge-sheet in the matter.

Learned counsel for the petitioner has also placed on record the documents (Annexure-9), according to which, the accused party has already handed over the possession of the land which is subject matter of this criminal case to the complainant party after submitting a compromise in the suit for cancellation of sale deed alleged to have been executed by impersonation.

Having regard to the submissions made by counsel for the petitioner and the fact that the accused party has handed over the possession of the land which is subject matter of this criminal case to the complainant, this Court without expressing any opinion on the merits or demerits of the case, deems it just and proper to enlarge the accused-petitioner on bail.

Accordingly, this second bail application under Section 483 BNSS is allowed and it is ordered that the accused-petitioner named above shall be enlarged on bail provided, he furnishes a personal bond in the sum of Rs.1,00,000/- together with two sureties of Rs.50,000/- each to the satisfaction of the learned trial Judge for his appearance before the Court concerned on all the dates of hearing and as and when called upon to do so.
8. In case, at any point of time during pendency of the trial if the accused party tries to back possession of the land-in-question from the complainant then the complainant may move an application for cancellation of this bail application.
