1. This hearing has been done through hybrid mode.

By the way of the present petition the petitioner is seeking quashing of FIR No. 336/2018, registered at Police Station Swaroop Nagar, Delhi, for the offences punishable under Sections 498A and 323 of Indian Penal Code, 1860 (hereinafter referred to as the ‘IPC’), and all consequential proceedings emanating therefrom on the basis of the settlement arrived at between the parties.
3. Issue notice. The learned APP accepts notice on behalf of the State.
4. The petitioners and respondents no. 2 are present before this Court and have been identified by their counsel and Investigating Officer.
5. Briefly stated, the marriage between Petitioner No.1 and Respondent No.2 was solemnized on 31.07.2011 in accordance with Hindu rites and This is a digitally signed order. ceremonies. Out of the said wedlock, no child was born. Owing to matrimonial discord and temperamental differences, the parties started residing separately with effect from 21.07.2018. Thereafter, Respondent No.2 lodged the present FIR against the Petitioners. During the pendency of the proceedings, with the intervention of family members and other respectable persons, the parties amicably resolved all their disputes before the Counselling Cell, North District, Rohini Courts, New Delhi, and executed a Settlement Agreement dated 08.05.2023.

Learned counsel for the petitioners submits that, in terms of the settlement, the balance settlement amount of ₹1,00,000/- (Rupees One Lakh only) has been handed over to respondent no. 2 today in Court by way of Demand Draft No. 040518. It is further submitted that, with the said payment, the entire settlement amount stands paid and the terms and conditions of the settlement have been fully complied with. Nothing further remains payable by either party under the settlement.

On a query made by this Court, respondent no. 2 who has been identified by the IO, has categorically stated that she has entered into compromise, vide Settlement Agreement dated 08.05.2023. , out of her own free will and without any pressure, coercion or threat. Therefore, she has no objection if the present FIR is quashed.

In view of the above, that the parties have amicably resolved their differences out of their own free will, and without any coercion, no useful purpose will be served by continuing the proceedings, rather the same would create further acrimony between them. It would thus be in interest of justice to quash the abovementioned FIR and the proceedings pursuant thereto. There is no legal impediment in quashing the FIR in question. 9. Accordingly, FIR No. 336/2018, registered at Police Station Swaroop Nagar, Delhi, for the offences punishable under Sections 498A and 323 of the IPC along with all consequential proceedings emanating therefrom, is hereby quashed.
