Case is called out. None appears on behalf of the petitioner to press the instant writ petition. However, Mr.P.K.Bhaduri, learned Deputy Advocate General appearing for respondents No.1, 2 and 6/State, is present. 2. The present writ petition has been filed by the petitioner with the following prayers: “10.1 That, this Hon'ble Court may kindly be pleased to direct the respondent no. 2 to refund the undisputed Additional Performance Security (APS) of Rs. 21.04 lakh to the petitioner forthwith as per terms of the contract and clause 40 of the Standard Bidding Documents (SBD) with 18% interest from completion of the work until the date of actual refund, within stipulated time, in the interest of justice. 10.2 Any other relief which may be suitable in the facts and circumstances of the case, may also be granted.” 3. The petitioner has also filed writ petition being WPC No.415/2026 with following reliefs:- "10.1 That, this Hon'ble Court may kindly be pleased to direct the respondent no. 2 to refund the undisputed Additional Performance Security (APS) of Rs. 25.13 lakh to the petitioner forthwith as per terms of the contract and clause 40 of the Standard Bidding Documents (SBD) with 18% interest from completion of the work until the date of actual refund, within stipulated time, in the interest of justice. 3 10.2 Any other relief which may be suitable in the facts and circumstances of the case, may also be granted." 4. The aforesaid writ petition was dismissed as withdrawn by the petitioner, without any liberty, vide order dated 2.2.2026. 5. Today when the case is called out, none appears nor any representation is made on behalf of the petitioner to press this writ petition. 6. It transpires that the petitioner has lost interest in pursuing the matter. 7. Accordingly, the instant petition is dismissed on this ground alone.
