2026:HHC:25776 IN THE HIGH COURT OF HIMACHAL PRADESH, SHIMLA Execution Petition No.406 of 2025 in CWP No.2494 of 2023 Decided on: 01.07.2026 Surinder Vashistha … Petitioner Versus State of Himachal Pradesh and another … Respondents Coram Hon’ble Mr. Justice Ajay Mohan Goel, Judge. Whether approved for reporting?1 ____________________________________________________ _ For the petitioner: Mr. Prem P. Chauhan, Advocate. For the respondents: Mr. Pushpinder Jaswal, Additional Advocate General. Ajay Mohan Goel, Judge (Oral) A perusal of the order passed by the Court demonstrates that there was no adjudication by the Court on merit and the only observation while disposing of the petition was that in the event of any representation being filed by the petitioner, the same be decided by the Authority. 2. Thus, in light of the fact that the Authority has taken a decision, this Court is of the considered view that if the petitioner is aggrieved by the same, the course open is to file a writ petition. 3. Learned Counsel for the petitioner prays for and is allowed to withdraw this petition with liberty to the petitioner to assail the order passed by the Authority by way of writ petition, if so advised. The petition stands disposed of, so also the pending miscellaneous application(s), if any.
