The writ petition has been filed, inter alia for the Patna High Court CWJC No.6339 of 2026(2) dt.11-05-2026 2/4 following reliefs:- “I) For issuance of an appropriate direction, order, or writ in the nature of mandamus commanding the respondents to dispose of the representation within a reasonable time, as contained in Annexure P-2 of this writ application, wherein the petitioner requested action against respondent nos. 9 to 14 who have illegally and forcibly captured her society plot situated at Khata No. 475/260, Keshra Survey No. 6125/6172, Jamabandi No. 14341, Present Part - 92, Page No. 9900, Halka - Nagar Parishad, Thana No. 35, Society Plot No. 16A (originally Plot No. 16). measuring 1400 sq. fit. Mouza -Phulwari Sharif District Patna. The petitioner further prays that such action be taken after duly noticing respondent no. 8 and examining the society plot map, as the said map can clarify the entire dispute. No action has been taken till date, and the petitioner remains at the mercy of the private respondents. II) For issuance of an appropriate direction, order, or writ in the nature of mandamus commanding the respondents to conduct an enquiry and take appropriate action against the officer or person responsible for submitting the incorrect report regarding the nature of the land, which has resulted in contradictory subsequent mutations of the same property after mutation in favour of the petitioner. The land in question is the Patna High Court CWJC No.6339 of 2026(2) dt.11-05-2026 3/4 petitioner's society plot situated at Khata No. 475/260, Keshra Survey No. 6125/6172, Jamabandi No. 14341, Present Part 92, Page No. 9900, Halka - Nagar Parishad, Thana No. 35, Society Plot No. 16A (originally Plot No. 16), measuring 1400 sq. ft., Mouza Phulwari Sharif, District Patna. III) For issuance of an appropriate direction, order, or writ in the nature of mandamus commanding the respondents to direct respondent no. 8 to produce the copy of the society plot map, and upon verification of the petitioner's plot situated at Khata No. 475/260, Keshra Survey No. 6125/6172, Jamabandi No. 14341, Present Part 92, Page No. 9900, Halka Nagar Parishad, Thana No. 35, Society Plot No. 16A (originally Plot No. 16), measuring 1400 sq. ft., Mouza -Phulwari Sharif, District Patna, to correct the wrong mutation showing a road in favour of the private respondents with respect to the petitioner's land. The petitioner further prays that the officer or person responsible for such deliberate mistake be punished in accordance with law, as the wrongful mutation has caused her mental, physical, and economic harassment.” 3. It is submitted on behalf of the petitioner that private respondent nos. 9 to 14 have filed Land Dispute Case No. 54 of 2025-2026 before the Court of DCLR, Sadar, Patna, Patna High Court CWJC No.6339 of 2026(2) dt.11-05-2026 4/4 with a view to grab the petitioner’s land for construction of a private road and the said proceeding is still pending for adjudication. Learned counsel further submits that the petitioner may be permitted to file objection before the DCLR, Sadar, Patna. 4. Since the issue in question is already sub judice before the learned DCLR, Sadar, Patna, this Court is not inclined to entertain the writ application on merits. 5. However, liberty is granted to the petitioner to raise all factual and legal objections before the DCLR, Sadar, Patna who shall consider and dispose of the matter by a reasoned and speaking order, preferably within a period of six months from the date of receipt/production of a copy of this order. 6. With the aforesaid liberty and direction, the writ application stands disposed of. shyambihari/- (Khatim Reza, J) U
