2. This is an application filed under Section 483 BNSS, 2023, praying for bail in connection with Abhayapuri P.S. Case No. 189/2026 under Section 3(5)/3(6)/3(7)/3(8)/61(2)/316(5)/112 of BNS, 2023.
3. The FIR was lodged on 27.07.2026 before the Officer-in-Charge, Abhayapuri police station by one Bobita Chetia, Block Project Manager alleging that the accused/applicant being the Secretary of BRC has diverted Government fund amounting to Rs.52,76,000/- to the personal account of herself as well as one Mrs. Morjina Khatun, President, BRC during the period of 04.02.2025 to 10.06.2026 without any lawful authority and violation of the applicable financial rules and procedures.
4. On receipt of the FIR, the police registered Abhayapuri P.S. Case No. 189/2026 under the aforementioned sections.
5. The learned counsel for the accused/applicant submits that the accused/applicant is behind the bar for last 39 days and since the investigation basically involves with documentary evidence and those have already been seized by the police, further custodial detention of the accused/applicant may not be required in the instant case. He further submits that since the accused/applicant is a lady and local residence, there is no flight risk of the accused/applicant in the instant case. He, therefore prays bail to the accused/applicant at this stage.
6. Mr. K. Baishya, learned Additional Public Prosecutor submits that there are sufficient materials against the accused/applicant of her involvement in the offence as alleged in the FIR.
7. The case diary in the instant case has already been received and the same is perused.

8. On perusal of the case diary and on finding sufficient incriminating materials against the accused/applicant, this Court is not inclined to grant bail to the accused/applicant at this stage.
