JUSTICE SACHIN SHANKAR MAGADUM - 3 - HC-KAR NC: 2026:KHC:12904 WP No. 6886 of 2026 ORAL ORDER The captioned petition is filed challenging the action of respondent No.2 in evaluating and accepting the commercial bid of respondent No.5 bearing Bid No.B6278637 pursuant to the tender notification bearing Ref. No.DYES/2025-26/IND0089. The petitioner has also sought a writ of mandamus directing respondent No.2 to forthwith re-verify the eligibility documents of respondent No.5 in terms of the petitioner’s representation dated 11.02.2026 and consequently to consider the petitioner’s representation/objection dated 20.02.2026. 2. Learned AGA, on instructions, has filed a memo today and produced documents indicating that the work order dated 12.02.2026 has already been issued by the department in favour of respondent No.5. The respondent has also produced - 4 - HC-KAR NC: 2026:KHC:12904 WP No. 6886 of 2026 the registration certificate of establishment of respondent No.5 along with copies of the work orders earlier issued in favour of respondent No.5. Referring to these documents and particularly to the fact that the work order has already been issued, learned AGA submits that the present writ petition is not maintainable and that the petitioner has an efficacious alternative remedy under Section 16 of the Karnataka Transparency in Public Procurements Act, 1999. 3. Having regard to the fact that the work order has already been issued and in view of the availability of an alternative statutory remedy under Section 16 of the Karnataka Transparency in Public Procurements Act, 1999, this Court is of the opinion that the petitioner has to be relegated to avail the said remedy. - 5 - HC-KAR NC: 2026:KHC:12904 WP No. 6886 of 2026 Accordingly, the writ petition stands disposed of reserving liberty to the petitioner to avail the remedy under Section 16 of the Karnataka Transparency in Public Procurements Act, 1999.
