The present petition has been filed under Section 11(6) of the Arbitration and Conciliation Act, 1996 by the Petitioner seeking appointment of an Arbitrator to adjudicate upon the disputes which have arisen between the parties under the Advertising Agreement dated 07.08.2018 (hereinafter referred to as “Agreement”). 2. It is the case of the Petitioner that the Respondent approached the Petitioner for advertising of its products in HT Group, which is a media house owned by the Petitioner herein. It is stated that in terms of the Agreement, the Petitioner published the advertisements and raised invoices from time to time. However, the said invoices were not paid by the Respondent leading to disputes between the parties. It is stated that as on 20.05.2025, a sum of Rs.65,35,948/- is due and payable by the Respondent. Article 7.7 of the Agreement contains an arbitration clause by which the parties have agreed to get their disputes adjudicated through arbitration. The said clause specifically indicates that the venue of the arbitration shall be at New Delhi and therefore, this Court has the jurisdiction to entertain the present petition. 4. A notice under Section 21 of the Arbitration and Conciliation Act, 1996 was sent to the Respondent invoking arbitration on 29.07.2025 which has not been replied to by the Respondent. 5. Notice in the present Petition was issued on 07.05.2026. 6. There is no appearance on behalf of the Respondent today. The Office Report indicates that the Respondent has refused to accept service. Service is, therefore, complete. 7. In view of the fact that disputes have arisen between the Parties and the Agreement contains an arbitration clause, this Court is inclined to appoint an Arbitrator to adjudicate upon the disputes between the parties. 8. Accordingly, Ms. Shelly Bhasin, Advocate (Mob. No: 9811106073) is appointed as the Sole Arbitrator to adjudicate upon the disputes between the parties. 9. The arbitration would take place under the aegis of the Delhi International Arbitration Centre (DIAC) and would abide by its rules and regulations. The learned Arbitrator shall be entitled to fees as per the Schedule of Fees maintained by the DIAC. 10. The learned Arbitrator is also requested to file the requisite disclosure under Section 12(2) of the Act within two weeks of entering on reference. 11. All rights and contentions of the parties in relation to the claims/counter-claims are kept open, to be decided by the learned Arbitrator This is a digitally signed order.
