This petition is filed by accused Nos. 1 and 2 under Section 482 of BNSS praying to grant bail in Crime No. 261/2025 of Central CEN Crime Police Station registered for offence under Section 66(D) of Information and Technology Act, 2008 and Sections 318(2) and 318(4) of BNS. 2. Heard learned counsel for petitioners and learned Additional SPP for respondent - State. - 3 - HC-KAR NC: 2026:KHC:8423 CRL.P No. 16373 of 2025 3. Learned counsel for petitioners would contend that petitioners are son and mother and they are selling agents for reputed institutions. Petitioner No. 1 went on tour to Jamantara of Jharkhand State. He lost his bag containing cheque book, ATM card, sim card and Bank passbook on 27.07.2025 and in that regard he had filed complaint on 07.08.2025. Petitioners are not aware of any amount credited to their bank account. Petitioners are also victims. Offences alleged against the petitioners are not punishable either with death or imprisonment for life. Petitioners are ready to cooperate with the Police in investigation and abide by any conditions to be imposed by this Court. There are no criminal antecedents of the petitioners. With this, he prayed to allow the petition. 4. Per contra, learned Additional SPP would contend that from the account of the complainant, Rs.19,95,618/- has been transferred to the bank account of these petitioners maintained with ICICI Bank. Apart from that several huge amounts were credited to the bank - 4 - HC-KAR NC: 2026:KHC:8423 CRL.P No. 16373 of 2025 account of the petitioners. The matter is under investigation. Petitioners are required for custodial interrogation. With this he prayed to reject the petition. 5. Having heard learned counsel for the parties, the Court has perused the charge sheet, complaint and other materials placed on record. 6. Case has been registered on receipt of complaint dated 02.08.2025 against unknown persons. Complainant has lost totally Rs.1,04,43,097/- Which is transferred to different bank accounts. One of the bank accounts mentioned is the bank account of the petitioners maintained with ICICI bank in the name of company of the petitioners. The petitioners are doing business and they have also produced their income tax returns and other documents. Petitioners are also stated to be the victims. Petitioners have not utilized any amount credited to their bank account. Petitioners have not authorized transfer of the amount credited to their bank account. Petitioners are ready to cooperate with the Investigating Officer in the - 5 - HC-KAR NC: 2026:KHC:8423 CRL.P No. 16373 of 2025 investigation and abide by any conditions to be imposed by this Court. There are no criminal antecedents of the petitioners. 7. Considering the above aspects, petitioners have made out case for grant to anticipatory bail with conditions. In the result, the following; O R D E R Petition is allowed Petitioners are ordered to be released on bail in the event of their arrest in Crime No. 261/2025 of Central CEN Crime Police Station subject to following conditions: I. Petitioners shall voluntarily appear before the Investigating Officer within 15 days from this day and execute bail bond for sum of Rs.1,00,000/- each with one surety for the likesum to the satisfaction of the Investigating Officer. - 6 - HC-KAR NC: 2026:KHC:8423 CRL.P No. 16373 of 2025 II. Petitioners shall appear before the Investigating Officer whenever called for and cooperate for investigation. III. Petitioners shall appear before the Investigating Officer on every Sunday between 10.00 a.m. and 02.00 p.m. for a period of 2 months or till filing of the final report whichever is earlier. IV. Petitioners shall not directly or indirectly make any inducement, threat or promise to any person acquainted with the facts of the case so as to dissuade him from disclosing such facts to the Court or to any Police officer or tamper with the evidence.
