After some argument, learned advocate appearing for the petitioner on February 20, 2026 submitted on instruction that the petitioner shall pay the entire outstanding dues by installments. In the light of the stand taken by the petitioner on February 20, 2026, the petitioner was given liberty to file the affidavit in terms of the submission made by the learned advocate on February 20, 2026. 2 Pursuant to the said order the petitioner has filed an affidavit affirmed on February 23, 2026 which is taken on record. A copy of such supplementary affidavit has also been served upon the learned advocate for the Contai Co-operative Agricultural and Rural Development Bank and the Assistant Registrar of Co-operative Societies. In the said affidavit the petitioner undertook to deposit a sum of Rs. 4 lacs by February 24, 2026 and the balance amount after adjusting the fixed deposit lying with the bank and any membership fees by March 20, 2026. The relevant part of the said affidavit is extracted hereinbelow: “2. That pursuant to the direction of His Lordship The Hon'ble Justice Hiranmay Bhattacharyya on the 20th February, 2026, as was informed to me by my advocate I am required to deposit a sum of Rs. 4,00,000/-, to the respondent no. 2 by 24th February, 2026. I undertake to tender the said sum of Rs. 4,00,000/-, as had been directed by the Hon'ble Court. 3. I undertake to pay the balance of Rs. 9,08,813/- after adjusting Rs. 4,00,000/- and 50,000/- paid by me on 4th February, 2026, and also after adjusting the fixed deposit lying with 3 the bank and my membership share fees to the respondent no. 2 bank by 20th February, 2026. 4. I say and undertake to abide by the terms of payment as may be directed by this Hon'ble Court.” Learned advocate appearing for the petitioner, however, points out that there is a typographical error in paragraph 3 of the said affidavit and the date mentioned therein should be read as March 20, 2026. Petitioner is given leave to file a supplementary affidavit in that regard on or before February 27, 2026. A copy of such supplementary affidavit be served upon the learned advocates for the respective parties. Since the petitioner has undertaken to pay off the entire dues by two installments, the first of such installment by February 24, 2026 and the balance amount by March 20, 2206, there shall be an order of stay of operation of the notice of proclamation dated December 4, 2025 till March 21, 2026. With the above observations, the writ petition stands disposed of. At this stage the learned advocate appearing for the petitioner prays that a direction should be passed 4 upon the bank to intimate the outstanding amount after adjusting the amount on account of fixed deposit that is lying with the bank and the membership fees and after adjusting the payment that will be made by the petitioner by February 24, 2026. The authority of the Contai Co-operative Agricultural and Rural Development Bank, being the 2nd respondent, is directed to intimate the petitioner on or before March 6, 2026 the amount which the petitioner will be required to pay after adjusting the amount already paid by the petitioner and the amount lying in fixed deposit and membership fees.
