The doctor has not opined that the petitioner requires hospitalization or that his medical condition is life-threatening or cannot be managed while in judicial custody.

Further, Dr. Mahesh Narayana Tiwari, Consultant Neurosurgeon, verified that the petitioner had undergone spine surgery in the past at Hope Hospital, Meerut, U.P., and had attended the OPD for follow-up examination. The petitioner had also shown him the medical documents of Guru Teg Bahadur Hospital, Delhi and Dr. Sandeep Sahgal, Meerut, U.P. As per the doctor's verification, the petitioner was examined and advised continuation of treatment/follow-up. There is no opinion that the petitioner is bedridden, requires emergency surgery or cannot receive treatment while lodged in jail. The doctor also advised him to continue treatment either from his previous doctor or from GTB Hospital, Delhi.
6.
Learned counsel for the petitioner submits that the petitioner requires follow-up treatment for Hepatitis-C.
7. I have considered the submissions and perused the status report. The medical verification clearly indicates that the petitioner has merely been advised diagnostic investigations and follow-up treatment. Admittedly, no surgery has been advised.
8. It may also be observed that, if the need so arises, the petitioner can be provided appropriate medical treatment while in judicial custody from AIIMS or Dr. Ram Manohar Lohia Hospital.
