Heard the parties. 2. The petitioner, in this writ petition, prays for following relief:- “I. For the issuance of appropriate writ/writs, order/orders, direction/ directions or a writ in the nature of Mandamus commanding upon the respondent for not vacating the standing house and premises of the petitioner as he and his entire family are living there in the standing house, including kacha three rooms, one bath room, one wash room, who were living in the Polytechnique campus Dhanbad, without prior rehabilitation and resettlement to another place, and compensating the petitioner family, as they were living there since 1968 when his grandfather was on the post of Clerk serving his duty in the Polytechnique college, Dhanbad. II. For the issuance of appropriate writ/writs, order/orders, direction/directions or a writ in nature of Mandamus commanding upon the respondents for payment of the amount of compensation with statutory interest in favour of the petitioners’ family.” 3. It is an admitted case of the petitioner that he is not the title holder of the land in question. It is also admitted that the house which petitioner is referring to is within the premises of 2026:JHHC:8690 2 Polytechnique College, Dhanbad. 4. It is the case of the petitioner that his grandfather was serving as a Clerk in Polytechnique College, Dhanbad and he has constructed his house within the said campus and is residing. The grandfather is now dead. There are no documents to suggest that this land was ever allotted to this petitioner or his grandfather. Learned counsel for the petitioner, on instruction of the petitioner, admits that on verbal communication, the construction was made. 5. From the aforesaid submission, it is quite clear that the action of the petitioner is nothing but an outright encroachment of the Government property which cannot be allowed. Thus, no relief can be granted to the petitioner, this writ petition stands dismissed. The respondents are direct to take steps for evicting the encroacher from the property in question. 6.
