This is 02nd Bail Application filed under Section 483 of the Bhartiya Nagarik Suraksha Sanhita, 2023 for grant of regular bail to the applicant in Crime No. 122/2023 registered at Police Station Kusami, District-Balrampur Ramanujganj (C.G.), for the offence punishable under Sections 302 of IPC, 1860. 2. The first bail application of the applicant was rejected on merits by this Court on 12.06.2025 in MCRC No. 4081/2025. 3. The prosecution story, in short, is that on 01.12.2023, the deceased, Lalchand, demanded repayment of money due from
2 the applicant/accused, whereupon the applicant/accused, in a fit of rage, threw Lalchand to the ground and struck his chest with a stone, thereby causing his death. Based on above, offence has been registered against the applicant. 4. Learned counsel for the applicant submits that the applicant is innocent and has been falsely implicated in the present case. He further submits that the evidence collected by the prosecution is primse facie insufficient to establish the applicant’s guilt and out of total 23 witnesses, 07 has already been examined. He submits that the applicant is in jail since 05.12.2023 and the trial is likely to take considerable time to conclude, therefore, the applicant may be enlarged on bail. 5. Per contra, learned State Counsel opposes the bail application and submits that there is no change in circumstances, looking to the nature and gravity of the offence, he may not be enlarged on bail. 6. I have heard learned counsel for the parties and perused the case diary. 7. Having considered the submission of the learned counsel for the parties and the fact that the first bail application of the applicant was dismissed on merits in MCRC No. 4081/2025 on 12.06.2025 and it appears that there is no change in circumstances and out of 23 witnesses, only 07 have been examined, therefore, at this stage, I do not find it appropriate to release the applicant on bail.

8. Accordingly, the bail application filed under Section 483 of BNSS, 2023 is rejected. 9. However, considering the fact that the applicant is in jail since 05.12.2023 about 02 years 01 months 22 days. It is an exceptional case, therefore, concerned trial Court is directed to expedite the trial as early as possible preferably within a period of 04 months. 10. Office is directed to sent a certified copy of this order to the trial Court concerned for necessary information and compliance forthwith. sd/- (Sanjay Kumar Jaiswal)
