The petitioner is apprehending his arrest in connection with Chouparan P.S. Case No.10/2025, registered for the offence under Sections 317(5), 3(5) of the BNS, Section 21 of M.M.D.R. Act, Rules 9/13 of J.M.P.I.M.T.S. Rules, Rule 54 of J.M.M.C. Rules and Section 30(ii) of Coal Mines Act, pending in the Court of the learned Judicial Magistrate, 1st Class, Hazaribagh. 3. Learned counsel appearing for the petitioner submits that the petitioner is neither the owner nor driver of the truck. He further submits that the allegations are made that 40 tonnes of raw coal were being carried in the said truck. He also submits that the driver has disclosed mobile number of the petitioner saying that the said consignment belongs to the petitioner. He next submits that the petitioner has got no criminal antecedent, as disclosed in paragraph 12 of this application. 4. Learned counsel appearing for the State opposed the prayer and submits that the mobile number of the petitioner has been provided by the said driver. 5. Considering that the petitioner is neither the owner nor driver of the ( 2026:JHHC:3995 ) -2- A.B.A. No. 825 of 2026 truck and he has got no criminal antecedent, as disclosed in paragraph 12 of this application and only on the basis of mobile number the petitioner has been implicated in the case and in that view of the matter, the petitioner is directed to surrender before the learned Court within two weeks from today and the learned Court shall release the petitioner on such terms and conditions as the learned Court may deem fit and proper. 6.
