No. 129 of 2025 arising out of Palkot P.S. Case No. 03 of 2002 corresponding to Spt. G.R. No. 79 of 2025 for the offence registered under Sections 302, 201/34 of the Indian Penal Code pending in the Court of learned Additional Sessions Judge-V, Gumla, is pressed into motion. Father of the deceased is informant of the case. As per the FIR, lodged on 02.02.2002, his son Raju Nayak went missing from his house on 28.01.2002. It is further stated that he had taken liquor and was last seen with one Bhukhan Nayak in the house of Rasmuni Devi. On 02.02.2002, his dead body was found floating in a well. The FIR was lodged against unknown and his name has come-up during investigation. It is submitted by the learned counsel on behalf of the petitioner that there is no legal evidence against him and the only material is confessional statement of the co-accused. Learned A.P.P. opposed the bail petition. It is submitted that he has absconded since last 23 years and the handkerchief of the deceased was recovered from the house of this petitioner and his name has come-up in the re-statement of the informant. There is no direct eye witness to the incidence and only sketchy circumstantial evidence has been put forward. Under the circumstances, the above named petitioner is directed to be released on bail on furnishing bail bond of Rs.25,000/-(Twenty Five Thousand) with two sureties of the like amount each to the satisfaction of the Court below.
