1. Heard Mr. Nocklei M. Konyak, learned counsel for the Applicant/Petitioner. Learned counsel, Ms. P. Mhonbeni Ezung is present for Respondent No. 1 and Ms. Kim Pienyu for Respondent No. 2.

By filing the instant I.A. under Order I Rule 10(2) of the CPC, the Applicant has prayed for impleadment of Shri Abhijit Sinha, IAS, Principal Secretary to the Government of Nagaland, Department of P&AR, Government of Nagaland as Respondent No. 3 and Shri Ajit Kumar Verma, Deputy Commissioner, Mokokchung as the Respondent No. 4, on the ground that at paragraph 5 of the affidavit-in-opposition filed by the Respondent No. 1 it is stated that the P&AR Department has to issue a clearance to the effect that the Petitioner married Lt. T.K. Gopalan. Therefore, only on the strength of the verification report, without the parent department providing the service particulars in the prescribed format and the P&AR Department issuing clearance to that effect, the Office of the Accountant General cannot authorize the pension and in view of such statement, the P&AR Department needs to be impleaded as a necessary party.
3. It is further stated that by the order of this Court dated 25.09.2023 passed in WP(C)/227/2021, the Deputy Commissioner, Mokokchung was
directed to conduct an inquiry for inclusion of the Petitioner’s name as nominee in the PPO Book. Therefore, the Deputy Commissioner, Mokokchung is also required to be impleaded as a party in the instant proceedings.
4. This Court has perused the order dated 25.09.2023 passed by this Court in WP(C)/227/2021. In the said writ petition it is seen that the Department of P&AR has not been impleaded as a party respondent. Accordingly, a direction was issued only to the Commissioner & Secretary, Home Department, Nagaland; the Director General of Police, Nagaland;
Page No.# 4/4 the Superintendent of Police, Mokokchung Nagaland; the Accountant General, Nagaland; and the Treasury Officer, Mokokchung, Nagaland. It is also seen that this Court had directed the Deputy Commissioner, Mokokchung to inquire into the matter of pension in respect of the Petitioner and to take appropriate action in terms of the rules so as to redress the grievance of the Petitioner expeditiously. This Court is therefore of the view that the Deputy Commissioner, Mokokchung can be impleaded as a Respondent/Contemnor in the instant application. However, the Department of P&AR has not been impleaded as a party in the writ petition, and therefore, no direction was issued to the P&AR Department. Accordingly, the prayer of the Petitioner for impleadment of the Principal Secretary, P&AR Department, Government of Nagaland is rejected.
5. The Applicant/Petitioner shall take steps by filing an amended cause title in respect of Shri Ajit Kumar Verma, IAS, Deputy Commissioner, Mokokchung as Respondent No. 3 in COP(C)/7/2026 within 3 (three) days from today and thereafter take steps for service on the newly impleaded Respondent No. 3 by Speed Post as well as usual process within 3 (three) working days.
