By way of the present petition filed under Section 528 of the Bharatiya Nagarik Suraksha Sanhita, 2023 (hereinafter referred to as the ‘BNSS’), the petitioner seeks quashing of FIR No. 459/2012, registered at Police Station Vijay Vihar, Outer District, Delhi, for the offences punishable under Section 506 of the Indian Penal Code, 1860 (hereinafter referred to as the ‘IPC’), and under Sections 25 and 30 of the Arms Act, 1959, and all consequential proceedings emanating therefrom, on the basis of the settlement arrived at between the parties.

Brief facts of the case are that the present FIR came to be registered in relation to a dispute concerning the sale of property belonging to Respondent No. 2. Learned counsel for the Petitioner submits that the Petitioner and Respondent No. 2 are neighbours, and that the dispute between them has been amicably settled vide Memorandum of Settlement dated 29.05.2026. In terms of the settlement, the Petitioner agreed to pay a sum of Rs. 3,00,000/- to Respondent No. 2, a part whereof had been paid earlier and the balance whereof has been paid in cash today morning, whereby the settlement amount stands paid in full and the settlement has been fully and finally concluded between the parties. 6. On a query made by this Court, Respondent No. 2, who has been duly identified by the IO, has categorically stated that he has entered into the settlement vide Memorandum of Settlement dated 29.05.2026 out of his own free will and without any pressure, coercion or threat. Therefore, he has no objection if the present FIR is quashed. 7. In view of the above, and given that the parties have amicably resolved their differences out of their own free will and without any coercion, no useful purpose would be served by continuing the proceedings rather, the same would only create further acrimony between them. It would thus be in the interest of justice to quash the abovementioned FIR and the proceedings pursuant thereto. There is no legal impediment in quashing the FIR in question. 8.
