1. This petition has been filed seeking directions for release of Rs. 6,00,000/- from the settlement amount of Rs. 32,00,000/- for the financial needs of petitioner no. 1/Ms. Soni Singh in order to repay her borrowings, repair her house and for survival of the family. 2. The accident occurred on 23rd March 2024, when the deceased was travelling on a motorcycle and was hit by the offending truck, resulting in his death. The compensation amount was settled between the parties for a sum of Rs. 32,00,000/-, payable to the claimants, namely, petitioner no. 1 (the wife) and petitioner nos. 2 and 3 (the minor children). The claim petition was disposed of by the Tribunal on 15th September 2025. 3. In January 2026, the petitioners filed an application for disbursement of the settlement amount. 4. out of the total sum of Rs. 32,00,000/-, an amount of Rs. 17,00,000/- be apportioned in favour of petitioner no. 1, while Rs. 7,50,000/- each be apportioned in favour of petitioner nos. 2 and 3, who are minor children. 5. Out of the amount apportioned to petitioner no. 1, only 10%, i.e., Rs. 1,70,000/-, was directed to be released immediately, whereas the remaining amount was directed to be kept in a Motor Accident Claims Annuity Deposit ('MACAD') and released to her in a phased manner of Rs. 10,000/- per month. 6. Petitioner no. 1 has approached this Court seeking the release of a sum of Rs. 6,00,000/- from her share of the compensation amount, submitting that she has outstanding borrowings of approximately Rs. 2,50,000/- and is also required to undertake repairs to her house in Nepal, where she belongs. 7. The Court interacted with Ms. Soni Singh, petitioner no. 1, who was present in Court, and made queries regarding the aforesaid request, as to whether the long-term financial consequence was well considered by her. The Court found her responses, to be confident and assured.
Being satisfied with her understanding of the matter and the necessity pleaded, this Court deems it appropriate to allow the present petition and accordingly directs the release of Rs. 6,00,000/- out of the amount of Rs. 17,00,000/- apportioned in favour of petitioner no. 1. 8. The said amount will be released as a lump sum in favour of the petitioner no. 1 through her designated Saving Bank Account. 9. The balance amount of money will be kept in an interest-bearing FDR in amounts of Rs. 25,000/- each for periods of 1 month, 2 months, 3 months and so on, in succession as maybe calculated. FDRs shall be credited to the designated Savings Bank Account of claimant. The amount in FDRs on maturity would be released to the Savings Bank Account of claimant upon due verification. 10. Accordingly, the petition is disposed of. The petitioner will be at liberty to move an application for any release in case of any further requirement. 11. Pending applications (if any) are rendered infructuous. 12.
