Order on Board 21/04/2026
1. This is First anticipatory bail application under Section 482 of the Bhartiya Nagarik Suraksha Sanhita, 2023 has been filed by the applicant, who is apprehending his arrest in connection with Crime No.107/2026 registered at Police Station – Kanker, District-North Bastar, Kanker (C.G.) for the offences punishable under Sections 303(2) and 112(2) Bhartiya Nyay Sanhita (for short ‘BNS’), 2023.
2. Case of the prosecution, in brief, is that, the complainant filed the written complaint before the Police Station stating that, her minor child namely Aakib Musa with their associates when asked to bring money from his home, her minor child theft the gold ornaments and VAISHALI LUCKY NAGARIA Digitally signed by VAISHALI LUCKY NAGARIA Date: 2026.04.23 12:51:40 +0530
2 1 lakh rupees and the said article has been sold to present applicant. On the basis of memorandum statement of co-accused, the present applicant has been inserted as accused. Hence, this bail application.
3.
Learned counsel for the applicant submits that the applicant is innocent and has been falsely implicated in the present case. It is further submitted that a total of four accused persons are involved, including the present applicant, and the other three co-accused have already been granted regular bail by the learned trial Court. It is also submitted that one of the co-accused, who is a juvenile and the son of the complainant, committed the theft and that the stolen items were subsequently sold to the applicant. It is further contended that only on the basis of memorandum statement of co-accused persons, name of the present applicant came into light and the conclusion of the trial is likely to take a considerable amount of time; therefore, it is prayed that the applicant be released on anticipatory bail.
4. On the other hand, learned State counsel opposes the bail application and submits that although the co-accused persons have been granted regular bail by the learned trial Court and the applicant has no previous criminal antecedents, the applicant had purchased the stolen articles from the co-accused persons. Therefore, it is contended that the applicant is not entitled to the grant of bail.
5. I have heard learned counsel for the parties and perused the case diary.
6. Considering the facts & circumstances of the case, gravity of offence,
submissions made by learned counsel for the parties, considering the fact that the specific allegation against the applicant is that he knowingly purchased stolen property from the co-accused persons.
3 The nature of accusation and the role attributed to the applicant prima facie disclose his involvement in the offence, it cannot be a ground to grant him anticipatory bail therefore, I am not inclined to grant anticipatory bail to the applicant.
1. Accordingly, the anticipatory bail application of the applicant– Md. Aahad Adwani Alias Danish Adwani filed under Section 482 of Bhartiya Nagarik Suraksha Sanhita, 2023 involved in Crime No.107/2026 registered at Police Station – Kanker, District-North Bastar, Kanker (C.G.) for the offences punishable under Sections 303(2) and 112(2) Bhartiya Nyay Sanhita (for short ‘BNS’), 2023, is rejected.
2. Needless to say that the trial Court concerned is at liberty to proceed and conclude the trial expeditiously.
