1. At the very outset, Mr. Rao, learned counsel for the petitioner(s) would submit that respondent No.5/Chief Medical and Health Officer, Jagdalpur, District Bastar, issued a promotion order dated 13.11.2020, whereby juniors to the petitioners were promoted to the posts of Assistant Grade-III and Dresser Grade-2. He would further submit that the State Government cancelled the said promotion orders, which were impugned in WPS No. 2577/2021, WPS No. 2719/2021, and WPS No.
3 2718/2021.
He would contend that the High Court quashed the order of cancellation of the promotion order vide order dated 05.02.2026 and directed the respondent authorities to pass a fresh order strictly in accordance with law after affording due opportunity of hearing to the petitioners. He further contend that the petitioners may be permitted to make a detailed representation before respondent No. 5, and the said authority may be directed to consider the names of the petitioners for promotion over and above the private respondents who were promoted to the posts of Assistant Grade-III and Dresser. 2. On the other hand, learned counsel appearing for the respondents would oppose the submissions made by counsel for the petitioners and submit that the promotion order(s) dated 13.11.2020 have already been cancelled by the State on 30.03.2021; thereafter, the Co-ordinate Bench of this Court, set aside the same and directed the authorities concerned to issue fresh orders in accordance with law; thus, they argued that the petitions are not maintainable and deserve be dismissed. 3. Heard learned counsel for the parties and perused the documents, including the order passed in WPS No. 2577 of 2021 and other connected matters. 4. In WPS No. 2577/2021, the Coordinate Bench vide order dated 05.02.2026 quashed the order(s), whereby the promotion orders were cancelled by the State and respondent authorities have been directed to pass fresh order(s) in accordance with law after affording due opportunity of hearing to the petitioners, therefore, these writ petitions are disposed of, reserving liberty in favour of the petitioners to make a detailed representation before respondent No. 5 and in turn, the said authority is directed to consider the names of the petitioners for
4 promotion to the next higher posts, i.e., Assistant Grade-III and Dresser. 5. The authorities concerned shall honor the seniority list of Assistant Grade-III and Dresser, while taking decision with regard to their promotion. 6.
With the aforesaid observations and directions, these petitions are hereby disposed of. 7. No order as to costs. Sd/-
