The petitioner is apprehending his arrest in connection with Ramna P.S. Case No.155/2019, registered for the offence under Sections 147, 148, 149, 341, 323, 354 and 307 of I.P.C., pending in the Court of the learned Judicial Magistrate, 1st Class, Nagar Untari, Garhwa. 3. Learned counsel appearing for the petitioner submits that the police has investigated the matter and submitted chargesheet and the petitioner was not sent up for trial, however, the learned Court differing with the final form, has been pleased to take cognizance against the petitioner. 4. Learned counsel appearing for the State opposed the prayer and submits that the petitioner was also accomplice of Ram Chandra Yadav, who has assaulted on the head of the deceased and in view of that, anticipatory bail may not be granted to the petitioner. 5. Looking into the contents of the FIR, it transpires that the allegation is there against Ram Chandra Yadav to hit upon the head of the deceased. In the chargesheet, the petitioner was not sent up for trial, however, the learned Court differing with the chargesheet, has been pleased to take cognizance. ( 2026:JHHC:4052 ) -2- A.B.A. No. 7294 of 2025 In the attending facts and circumstances of the case, I am inclined to extend the privilege of anticipatory bail to the petitioner. 6. Accordingly, the above-named petitioner is directed to surrender before the learned Court within three weeks from today and in the event of his arrest or surrender, he shall be enlarged on bail on furnishing bail bond of Rs.25,000/- (Twenty Five Thousand) with two sureties of the like amount each to the satisfaction of learned Judicial Magistrate, 1st Class, Nagar Untari, Garhwa in connection with Ramna P.S.
