Heard learned counsel for the applicant and learned A.G.A for the State as also perused the record. This application under Section 529 BNSS has been filed seeking direction to the court concerned to conclude the trial of warrant/summon case no. 3927 of 2020 (State vs. Ram Sanwar and others), arising out of Case Crime no. 304 of 2017, under Sections 147, 148, 323, 504, 352, 294, 427, 506 452 IPC, Police Station Khajni, District Gorakhpur pending before the court of learned Judicial Magistrate-III, Gorakhpur, expeditiously within stipulated period. Learned counsel for the applicant submits that the charge-sheet was filed on 04.12.2017, whereupon cognizance was taken on 28.1.2020 and summons were issued to the accused persons, pursuant to which some accused persons have surrendered before the trial court and enlarged on bail. It is next submitted that the trial of the aforesaid case is pending before the court concerned since 28.1.2020 and since then, more than five years has been passed, but till today, neither charge has been framed nor same has been decided. Considering the fact that the proceedings of the subject case has remained pending since 2020, without expressing any opinion on the merits of the case, this application is finally disposed of with a direction to the court concerned to decide the aforesaid case in accordance with law, as expeditiously as possible, without granting any unnecessary or long Versus Counsel for Applicant(s) : Vivekanand Yadav Counsel for Opposite Party(s) : G.A.
