This petition is filed by the wife for the transfer of M.C.No.104/2025, filed by the husband for restitution of conjugal rights, pending on the file of the Senior Civil Judge and JMFC, Gangavathi, to the Principal Family Judge, Bengaluru. 3. Learned counsel for the petitioner stated that she is residing with her parents at Bangalore along with minor children, who are aged about 14 and 13 years and studying in 9th and 8th standard, respectively. It is also stated that she filed a criminal M.C. No. 1082/2025 for maintenance, and it is still pending. 4. Learned counsel for the respondent stated that their marriage was performed in the year 2009 and they lived happily till 2023. During that time, he financially helped her brother's marriage. When he requested for - 4 - HC-KAR NC: 2026:KHC:13379 CP No. 43 of 2026 refund of the said amount from her brothers and parents, the dispute arose between them, and from then onwards, she resided with her parents, and he and his mother, who is aged about 67 years, made best efforts to get her back to the matrimonial home and thus requested the matter to be referred to the Mediation Centre. 5. Considering the disputes stated by both the counsel and also the fact that their case is filed for restitution of conjugal rights and the fact that they resided together for 17 years and the ages of the children, this Court finds that there are no merits in the petition. With the above observations, the petition is dismissed. The Trial Court is at liberty to refer the matter to Medication Centre for reconciliation. Pending IAs., if any shall stand disposed of.
