Learned advocate appearing for the petitioner submits that the petitioner is in custody for about 19 months and till date only evidence of one witness is complete and the evidence of second witness is in progress. Learned advocate for the State opposes the prayer for bail and draws the attention of the Court to the statement under Section 164 of Cr.P.C. as well as the medico legal examination of the victim. Learned advocate for the petitioner thereafter emphasizes that presently the presiding officer of the court is on leave. Having considered the nature of the offence and the period of detention, I direct the learned trial court to release the petitioner on bail after the evidence of the victim is over. 2 With the aforesaid observations, CRM(M)364 of 2026 is disposed of.
